Terms & Conditions

These Terms govern the use of REVEND and transactions conducted through the REVEND marketplace.

Important

REVEND is a managed marketplace. REVEND does not generally own the products listed by sellers. Sellers remain responsible for the products they advertise and for supplying those products as advertised.

1. About REVEND

REVEND provides an online recommerce marketplace through which private sellers and approved business sellers may advertise products for sale and buyers may purchase those products.

REVEND facilitates and manages important parts of the transaction process, which may include payment processing, transaction records, delivery coordination, order tracking, buyer and seller communication, support and dispute management.

Unless REVEND is expressly identified as the seller of a particular product, the contract for the sale of the product is between the buyer and the seller. REVEND provides the marketplace and transaction infrastructure through which that sale takes place.

2. Acceptance of these Terms

By creating an account, listing a product, purchasing a product or otherwise using REVEND, you agree to these Terms and any policies incorporated into them.

If you do not agree to these Terms, you must not use REVEND to conduct a transaction.

3. Accounts

Users must provide accurate and current information when registering for and using REVEND.

You are responsible for activity conducted through your account and for keeping your login credentials secure.

REVEND may require reasonable identity, contact, payment, banking, business or transaction verification before allowing certain activities, releasing funds or continuing to provide services.

REVEND may restrict, suspend or terminate accounts that are used fraudulently, unlawfully or in material breach of these Terms.

4. Sellers and listings

Sellers are responsible for ensuring that every listing is truthful, accurate and sufficiently detailed for a reasonable buyer to understand what is being purchased.

A seller must accurately disclose:

  • the identity and description of the product;
  • its condition;
  • known defects, damage or material imperfections;
  • what is and is not included;
  • the correct quantity;
  • relevant specifications;
  • appropriate photographs of the actual product where required; and
  • accurate parcel and collection information needed for delivery.

Sellers may not deliberately hide defects, use misleading photographs, provide false specifications, misrepresent authenticity or supply a materially different product from the product purchased.

5. Sold as Advertised

The core transaction standard on REVEND is Sold as Advertised.

A seller must supply the product that was purchased in substantially the condition, quantity, specification and form represented in the listing.

Normal characteristics that were accurately disclosed in the listing do not make an item "not as advertised".

A buyer who receives an item that is materially different from its listing may use REVEND's dispute process, subject to these Terms, the evidence available and any applicable law.

6. Purchases are binding

When a buyer confirms a purchase and the transaction is successfully processed, the buyer is entering into a binding transaction with the seller.

REVEND is not intended to operate as a change-of-mind return system for ordinary marketplace transactions.

A buyer may not use the REVEND dispute process merely because the buyer later decides that they no longer want the product, found another product, changed their mind or no longer wish to complete an otherwise valid purchase.

Nothing in these Terms excludes, restricts or replaces a right or remedy that cannot lawfully be excluded under applicable South African law.

7. Buyer responsibilities

Buyers must:

  • review the listing before purchasing;
  • provide accurate delivery and contact information;
  • make payment through the approved REVEND transaction process;
  • cooperate reasonably with delivery arrangements;
  • inspect the delivered product as reasonably required;
  • raise genuine problems promptly through REVEND; and
  • provide truthful evidence when opening a dispute.

A buyer must not submit a false dispute, manipulate the dispute process, falsely claim non-delivery or deliberately misrepresent the condition of a delivered product.

8. Payments

Payments must be made through the payment methods made available by REVEND.

REVEND may use authorised third-party payment providers, banks and other financial service providers to process payments and related transaction services.

A transaction is not treated as successfully paid merely because a buyer attempted payment. REVEND may rely on confirmation from its payment systems or payment provider before treating an order as paid.

Users must not attempt to bypass REVEND's payment process for a transaction initiated through REVEND.

9. Seller payout

Seller funds are not necessarily released immediately when a buyer makes payment.

REVEND may manage or delay seller payout until the transaction reaches the appropriate completion stage, including confirmation of delivery and any applicable acceptance or dispute period.

If a valid dispute is opened, payout may be held while the matter is reviewed.

REVEND may also delay a payout where reasonably necessary to investigate suspected fraud, payment reversal, identity concerns, legal obligations or a material breach of these Terms.

10. REVEND fees

REVEND may charge a platform or handling fee for transactions conducted through the marketplace.

REVEND's current marketplace pricing model may apply different percentage fees according to product category, subject to a maximum platform fee of R2,500 per applicable transaction.

The applicable transaction price and charges presented by REVEND during the listing or purchase process form part of that transaction.

Delivery charges are separate from the product price and platform fee unless REVEND expressly states otherwise.

REVEND may change its fee structure prospectively. A fee change will not retrospectively alter the agreed pricing of a transaction already concluded unless required by law or agreed with the affected user.

11. Delivery and courier services

REVEND may coordinate delivery through one or more independent courier or logistics providers.

Available courier services, prices and estimated delivery times may depend on location, parcel information, availability and third-party courier systems.

Delivery estimates are estimates unless expressly stated otherwise.

Sellers must package products appropriately and provide correct parcel dimensions, weight, collection details and other information reasonably required for shipment.

Buyers must provide a valid delivery address, cellphone number and other information reasonably required to complete delivery.

REVEND may use courier tracking, collection records, delivery scans, signatures and other logistics information when determining transaction status or reviewing a dispute.

12. Disputes

REVEND's dispute process exists primarily for genuine transaction problems, including where a product is materially not supplied as advertised.

A change of mind is not, by itself, a valid REVEND dispute reason.

REVEND may request photographs, listing information, correspondence, courier records, packaging photographs, delivery evidence, serial numbers or other relevant evidence.

While a dispute is being reviewed, REVEND may hold the seller payout and take reasonable steps necessary to preserve the transaction.

REVEND may determine the appropriate platform outcome based on the listing, transaction records, evidence supplied by the parties, courier information, these Terms and applicable law.

Depending on the circumstances and applicable law, an outcome may include completing the transaction, arranging a return, refunding an amount, releasing seller funds or taking action against an account.

13. Seller fault and misrepresentation

Where a transaction fails because a seller materially misrepresented the product, supplied the wrong product or otherwise materially breached the Sold as Advertised obligation, REVEND may take appropriate action against the seller.

Subject to applicable law and the circumstances of the transaction, this may include:

  • holding or reversing seller payout;
  • recovering applicable transaction or logistics costs;
  • retaining or charging an applicable handling amount where lawfully permitted;
  • reducing seller reputation or trust indicators;
  • removing listings;
  • restricting selling privileges; or
  • suspending or terminating the seller account.

A buyer should not be penalised through REVEND's platform rules for a genuine transaction failure caused by the seller's material misrepresentation.

14. Returns and refunds

REVEND does not automatically provide a return or refund simply because a buyer changes their mind.

A return, refund or other remedy may be available where a product was materially not as advertised, where the transaction otherwise qualifies under REVEND's policies, or where a remedy is required under applicable law.

Where a return is authorised, the buyer must reasonably preserve the product and follow the return instructions provided through the REVEND process.

15. Prohibited and restricted products

Users may not use REVEND to advertise, sell or purchase goods that are unlawful to possess, advertise, sell, distribute or transport.

REVEND may prohibit or restrict categories of products because of legal, safety, payment-provider, courier, insurance or platform-risk requirements.

Prohibited or restricted products may include, depending on applicable law and REVEND policy:

  • illegal goods;
  • stolen property;
  • counterfeit goods;
  • unlawfully sold weapons or ammunition;
  • illegal drugs and controlled substances;
  • dangerous or prohibited chemicals;
  • fraudulent documents;
  • unlawfully traded personal information;
  • goods that infringe intellectual property rights; and
  • items prohibited by REVEND's payment or delivery partners.

REVEND may remove a prohibited listing without completing the transaction and may report suspected unlawful activity where legally required or appropriate.

16. Fraud and platform misuse

Users must not use REVEND for fraud, money laundering, payment manipulation, false disputes, identity misuse, account takeovers, artificial transactions, prohibited goods or any other unlawful activity.

REVEND may investigate suspicious activity and may temporarily restrict transactions, listings, accounts or payouts while an investigation is conducted.

REVEND may cooperate with payment providers, couriers, financial institutions, regulators and law-enforcement authorities where legally required or reasonably appropriate.

17. Reviews and seller reputation

REVEND may provide ratings, reviews, transaction history or other reputation indicators.

Reviews must be genuine and based on the relevant transaction or permitted user experience.

REVEND may remove fraudulent, abusive, manipulated, irrelevant or otherwise improper reviews.

18. Third-party services

REVEND relies on third-party services that may include payment providers, banks, couriers, hosting providers, communication providers and identity or fraud-prevention services.

Those services may be subject to their own operational rules, availability and legal terms.

REVEND may replace, add or remove third-party providers without requiring these Terms to identify each provider by name.

19. Availability of REVEND

REVEND aims to provide a reliable marketplace but does not guarantee uninterrupted or error-free availability.

The platform may occasionally be unavailable because of maintenance, technical failures, internet disruption, third-party outages, security measures or circumstances beyond REVEND's reasonable control.

20. Limitation of liability

To the maximum extent permitted by applicable law, REVEND is not responsible for indirect, incidental or consequential losses arising from the use of the platform or from a transaction between users where such liability may lawfully be excluded or limited.

REVEND does not manufacture, inspect or own every product advertised on the marketplace and cannot guarantee every statement independently made by a seller.

Nothing in these Terms excludes or limits liability or consumer rights to the extent that such liability or rights cannot lawfully be excluded or limited.

21. Privacy and personal information

REVEND processes personal information for purposes that may include account administration, marketplace operation, payment, delivery, support, dispute resolution, fraud prevention, security and legal compliance.

22. Electronic communications

By using REVEND, users agree that transaction notices, account notices, support communications and other legally permitted communications may be delivered electronically.

Users are responsible for keeping their contact information reasonably current.

23. Support and contacting REVEND

REVEND operates a request-first customer support model.

REVEND does not operate a public incoming customer-service telephone line.

Customers requiring assistance must submit a support request through the REVEND Support page. REVEND will then review the request and contact the customer by email or telephone where appropriate.

Transaction and dispute communications may be retained through REVEND systems where reasonably necessary for security, evidence, support and dispute resolution.

24. Changes to these Terms

REVEND may update these Terms from time to time to reflect changes to the platform, applicable law, business operations or third-party services.

The updated version and effective or update date will be made available through REVEND.

Changes will apply prospectively except where another application is required by law.

25. South African law

These Terms are governed by the laws of the Republic of South Africa, subject to any mandatory rights or jurisdiction that applicable law provides to a user.

Nothing in these Terms is intended to prevent a consumer from exercising a right or remedy available under applicable South African law.

26. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

A failure by REVEND to enforce a provision immediately does not automatically amount to a waiver of that provision.

These Terms, together with applicable REVEND policies and transaction-specific information presented to the user, form the terms governing use of the REVEND marketplace.
